1. Designated agent
Send copyright notices to our designated agent:
Copyright Agent, Aevon Health, Inc.
Miami, Florida, United States
Email: info@aevonhealth.com (subject line: "DMCA Notice")
2. Filing a takedown notice
To be effective, your written notice must include all of the following:
- A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
- Identification of the copyrighted work claimed to have been infringed.
- Identification of the material claimed to be infringing, with a URL or description specific enough for us to locate it.
- Your name, mailing address, telephone number, and email address.
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
- A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on their behalf.
Incomplete notices may delay our response. Under 17 U.S.C. § 512(f), knowingly making a material misrepresentation of infringement can result in liability for damages and legal fees.
3. Our response
Upon receiving a valid notice we will promptly remove or disable access to the material, notify the user who posted it where possible, and document the action. We aim to act within 5 business days.
4. Counter-notification
If you believe your material was removed by mistake or misidentification, you may send a counter-notice including: your signature; identification of the removed material and its former location; a statement under penalty of perjury that you have a good-faith belief the removal resulted from mistake or misidentification; and your name, address, telephone number, and consent to the jurisdiction of the U.S. District Court for your district (or the Southern District of Florida if outside the U.S.), and acceptance of service of process from the complaining party. We may restore the material in 10–14 business days unless the complainant files a court action.
5. Repeat infringers
In accordance with the DMCA and applicable law, we terminate the accounts of users who are determined to be repeat infringers.
